By accessing our website, engaging our services, or purchasing from us, you agree to be bound by the following Terms and Conditions. These terms apply to all users of our site and services, including customers, browsers, vendors, and others.
We may update these terms at any time, and it is your responsibility to check this page periodically for changes. Continued use of our services or website constitutes acceptance of those changes.
1. Who We Are
The Computer Man Ltd is an IT services and retail business based in the Cook Islands. We provide computer and mobile repairs, retail technology products, business IT solutions, and on-site support. All services and products are subject to availability and acceptance of these Terms.
2. Online Store & Retail Terms
- All prices are in NZD and include VAT unless otherwise stated.
- We reserve the right to limit quantities or cancel orders at our sole discretion.
- Product images and descriptions are for reference and may differ slightly from actual items.
3. Payment Terms
- All accounts are on a CASH ONLY basis unless otherwise applied for and agreed upon.
- Charge accounts holders are subject to 20th of the following month (EOM) payment terms unless otherwise stated.
- A 5% late payment fee applies to overdue invoices.
- Credit card payments incur a 3% surcharge.
- Early payment discounts are offered on a per term basis.
- All discounts apply only to current invoices and will be removed from any overdue accounts.
4. Quotes, Invoices & Deposits
- Quotes are valid for 7 days unless otherwise stated.
- Acceptance of a quote constitutes agreement to these Terms.
- Deposits are required for large orders, custom jobs, or special-order items.
- A cancellation fee may apply for custom or special orders that are already in progress.
5. Repairs & Service Jobs
- Diagnostics are chargeable at a minimum of $50.00 unless waived in writing.
- Repairs are covered by a 30-day workmanship warranty unless otherwise specified.
- Warranty does not cover misuse, physical damage, or third-party tampering.
- Customers may collect devices while awaiting parts. A deposit or partial payment may be required in such cases.
- Devices not collected within 60 days may be disposed of or resold to recover costs.
6. Shipping & Delivery
- Estimated delivery for special orders is 5–10 business days from acceptance of order, subject to freight and supplier timelines.
- We are not liable for courier or shipping delays.
- Risk in goods passes to the customer upon delivery or collection.
7. Returns, Exchanges & Refunds
- Returns are accepted within 7 days for unopened items in original condition.
- Opened or used products may be accepted at our discretion and may incur a minimum of 20% restocking fee.
- Faulty goods are covered by manufacturer warranties. We can assist with claims where possible.
- Labour charges are non-refundable unless due to proven fault by The Computer Man Ltd.
8. Warranties
- Manufacturer warranties apply to most retail products.
- Services (e.g., repairs) are warranted for workmanship only.
- We do not cover software/data loss or compatibility issues unless caused by our direct actions.
- Most goods retain a 12 month manufacturers warranty - this is solely on the discretion of the manufacturer and often required the goods to be returned to the manufacturer.
9. Limitation of Liability
We are not liable for any indirect or consequential losses including but not limited to loss of data, loss of business, or downtime. Liability for any direct damage is limited to the total value paid for the service or item in question.
10. Privacy & Personal Information
All personal information is handled in accordance with our Privacy Policy and Cook Islands Data Protection Laws. We do not share or sell customer information without consent.
11. Third-Party Services & Tools
We may use third-party tools (e.g., payment gateways, cloud services) which are subject to their own terms and policies. We are not responsible for issues arising from third-party services.
12. Governing Law
These Terms are governed by the laws of the Cook Islands. Any disputes shall be resolved under Cook Islands jurisdiction.
